POWER OF ATTORNEY:  

When you empower someone to act on your behalf, you are granting a power of attorney. You may describe the reason why you are not doing the specified work yourself; and sometimes you can waive this description. There are several types of powers of attorneys. Limited powers of attorney grant only narrow rights, like giving a friend your car-driving power or check-writing power while you are on a vacation or a business trip. In your power you could define a specified number of days through which the power might be in effect. After the expiry, it is revoked automatically. Durable power is comparatively a more multipurpose power in which the executants could grant the big tasks and vast authorized  acts to be done. General power is the most common power subdivided by Durable power.

Basically Power falls into two divisions:

In Pakistan, basically there are two types of powers: Special and General.

(1) Special Power: Covers some specified purpose, not only property but others, too. For example you can transfer the power to rent out the house or apartment situated in Pakistan, to deal all the affairs of tenancy, to take care of your children living in Pakistan, to proceed your case of divorce, property and criminal whatsoever in the civil or high court, to receive/collect  the payment from someone else individual or organization such as UNCC claim amount of Kuwait, to make process of Vikalatnama (Advocacy). Special Power is a temporary power which is automatically revoked after the work completed which given for. However you have the right to terminate or revoke it at any time as long as you are still competent. You can revoke for any reason or no reason at all. The person who holds your power of attorney must be told of your intention in writing. Thus it is better if you make a Termination of Power Deed while you intend to revoke. In case the Attorney becomes insane or disable, the power automatically turns to be ineffective and said to be terminated.

(2) General Power:  This  is  a  comprehensive  and  overwhelming  power  in  which  you  make conversion of all the rights to the Attorney.  Very often it is executed when you do  not  have  enough time to visit yourself and wish to get your property (real estate) disposed off through your reliable friend or relative living abroad on your behalf.  By this power your attorney can buy a property/real estate on your behalf.  You  need  to  furnish  with  the  following  information  for  making  the  General  Power  of  Attorney. It is appreciable if you write the word “Irrevocable” with General Power. In future if you want to end this power, you need to make a revocation in order to deactivate it.
